1. Acceptance of Terms

By creating an account or using NS Factura, you agree to these Terms of Service. If you do not agree, please do not use the platform. These terms constitute a legally binding agreement between you and New Street Development.

2. Description of Service

NS Factura is a cloud-based electronic invoicing platform that enables Costa Rican taxpayers to issue, transmit, and manage electronic fiscal documents (facturas electronicas, tiquetes, notas de credito/debito, and others) in compliance with Hacienda v4.4 regulations. The service is provided on a subscription basis. Feature availability depends on the plan selected.

3. User Obligations

By using NS Factura, you agree to: Provide accurate and up-to-date tax and company information. Use a valid digital signature certificate (.p12) issued by an authorized Costa Rican certification authority. Not use the platform to issue fraudulent or fictitious invoices. Maintain the confidentiality of your login credentials. Notify us immediately of any unauthorized access to your account. You are solely responsible for the accuracy and legality of the invoices you issue.

4. Plans and Payments

NS Factura offers free and paid subscription plans. Paid plans are billed monthly in US dollars (USD). Prices are subject to change with 30 days prior notice. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are not issued for partial billing periods. Free plan limits are subject to change.

5. Intellectual Property

All content, software, logos, and trademarks on NS Factura are the exclusive property of New Street Development. You may not copy, reproduce, modify, or distribute any part of the platform without prior written authorization. Your invoice data remains your property. We grant you a license to access and export your data at any time during your subscription.

6. Limitation of Liability

NS Factura is provided as is. We do not guarantee uninterrupted or error-free service. New Street Development shall not be liable for: Losses arising from Hacienda system outages or rejections outside our control. Errors in invoices caused by incorrect data provided by the user. Indirect, incidental, or consequential damages. Our maximum liability for any claim is limited to the amount paid by you in the last 3 months.

7. Governing Law

These terms are governed by the laws of the Republic of Costa Rica. Any disputes arising from the use of NS Factura shall be resolved in the competent courts of San Jose, Costa Rica. For questions about these terms, contact us at legal@nsfactura.com.
